Terms of service
These terms and conditions apply to all orders placed through montessoriheld.com by consumers and business customers.
1. Scope and seller
1.1 These terms and conditions apply to all contracts concluded between Tom Jeremy Knappmann, sole trader, trading as Montessoriheld ("we", "us", "the seller"), Talblick 7, 65760 Eschborn, Germany, and the customer through our online shop.
1.2 A consumer is any individual who enters into a contract for purposes which are wholly or mainly outside their trade, business, craft or profession.
1.3 A business customer is any individual or legal entity acting in the course of their trade, business, craft or profession.
2. How the contract is formed
2.1 The product descriptions in our online shop are an invitation to treat, not a binding offer.
2.2 You make a binding offer to purchase by completing the online order form and clicking the order button.
2.3 We may accept your offer within five days, by sending you an order confirmation, by delivering the goods, or by requesting payment. If we do not accept it within that period, your offer is deemed rejected and you are no longer bound by it.
2.4 Where you choose a payment method offered by PayPal, payment is processed by the relevant PayPal entity, subject to PayPal's own terms of use.
2.5 Before submitting your order you can review your entries and correct any input errors using the usual keyboard and mouse functions in your browser.
2.6 The contract is concluded in English.
2.7 Order processing and communication normally take place by email and automated order processing. Please make sure that the email address you provide is correct and that our messages can be delivered to you.
3. Your right to cancel
3.1 As a consumer you have a statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3.2 Full details, including how to cancel and the model cancellation form, are set out in our returns and cancellations policy.
4. Prices and payment
4.1 Unless stated otherwise in the product description, the prices shown are total prices per item. Delivery costs are shown separately and added at checkout.
4.2 The available payment methods are shown in our online shop and at checkout.
4.3 Where you choose a payment method offered through Shopify Payments, payment is processed by the relevant Shopify payments provider, subject to their own terms.
4.4 Payment is due immediately on conclusion of the contract, unless a different due date has been agreed.
5. Delivery
5.1 We deliver within the United Kingdom. Delivery times, cut-off times and delivery costs are set out in our delivery information.
5.2 If delivery fails for reasons within your control, for example an incorrect or incomplete delivery address, you bear the reasonable additional costs incurred.
5.3 Where the customer is a business customer, the risk of accidental loss or deterioration passes to the customer when the goods are handed over to the carrier.
5.4 We reserve the right to withdraw from the contract if we are not supplied correctly or in time through no fault of our own. In that case we will inform you without delay and refund any payment already made without delay.
5.5 Collection in person is not possible for logistical reasons.
6. Retention of title
The goods remain our property until they have been paid for in full.
7. Faulty goods and your statutory rights
7.1 We are under a legal duty to supply goods that are in conformity with the contract. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.
7.2 If goods are faulty, damaged in transit or not as described, please contact us at info@montessoriheld.com with your order number and photos. We will confirm the next step and cover the cost of returning the item. You can choose a replacement, a different product or a refund, in line with your statutory rights.
7.3 Nothing in these terms limits or excludes your statutory rights as a consumer.
7.4 Where the customer is a business customer, the customer must inspect the goods without delay and notify us of any obvious defects without delay.
7.5 Consumers are asked to report goods that arrive with obvious transport damage to the carrier and to inform us. This does not affect your statutory rights.
8. Liability
8.1 We are liable without limitation for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited by law.
8.2 Where we negligently breach a material obligation of the contract, our liability is limited to the loss that was foreseeable at the time the contract was concluded.
8.3 We are not liable for business losses. We only supply goods for domestic and private use.
8.4 These liability provisions also apply to the liability of our employees, agents and subcontractors.
9. Promotional vouchers
9.1 Vouchers issued free of charge as part of a promotion, with a limited validity period, can only be redeemed in our online shop and only within the stated period.
9.2 Individual products may be excluded from a voucher promotion where the promotion states this.
9.3 Vouchers can only be redeemed before completing the order. They cannot be applied afterwards.
9.4 Only one promotional voucher can be redeemed per order.
9.5 The order value must be at least the amount of the voucher. Any remaining balance is not refunded.
9.6 If the voucher does not cover the full order value, the difference can be paid using any of the payment methods offered.
9.7 The balance of a voucher is not paid out in cash and does not earn interest.
9.8 The voucher is not refunded if you return goods paid for wholly or partly with the voucher, unless required by law.
9.9 Vouchers are personal and may not be transferred to third parties.
10. Governing law
10.1 These terms are governed by the law of England and Wales, and any dispute may be brought before the courts of England and Wales.
10.2 If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of the country in which you live, and you keep the benefit of any mandatory consumer protection rules that apply there.
11. Complaints
If you have a complaint, please contact us first at info@montessoriheld.com. We aim to respond within 1 to 2 working days and to resolve every complaint directly with you.
